                  Whilst not strictly applicable in proceedings for financial remedies in family proceedings: relevance of CPR 38.6 in the court's determination of the incidence of costs of preliminary issues that had been discontinued: where allegations of conspiracy and fraud had been made and withdrawn shortly before trial, whether the principle that costs should be payable on the indemnity basis applied as much in financial remedy proceedings as it did in any other area of law.
