Where the claimants had obtained judgment at trial more advantageous than their own Part 36 offer and were entitled to the consequences contained in CPR 36.17(4), it was not appropriate to apply the enhanced interest rate to post-judgment interest. The correct approach was to have regard to the compensatory principle.
