                  [2024] Costs LR 1295

Family law costs: in long-running financial remedy proceedings, where both husband and wife had reached a prior agreement, and had requested the court to make “no order”, and to permit the wife to withdraw her financial remedy application, an application to set aside the order by a litigation funder, who had advanced a loan of £630,000 to the wife, would be refused because the court could not force parties to seek any orders.
