Part 36: where a Part 36 offer had been made by the respondent shortly before a preliminary trial, and the petitioner had sought to accept the offer some eight months later, the offer was no longer open for acceptance because by that time the issues in the case had been determined and the case decided, even though a valuation process was ongoing in relation to the petitioner's shares.
