                  Family law costs: where the respondent had not succeeded in resisting an appeal, had failed to make any offers to settle and strongly contested every aspect of the appeal, it would not be appropriate to order the appellant to pay the respondent’s costs to reflect the appellant’s litigation misconduct. However, the appellant’s misconduct would be taken into account by a discount of approximately 40% in the costs payable by the respondent to the appellant.
