Aarhus Convention: where a claim relating to a contested area of land had been brought under s 14 of the Commons Registration Act 1965, the nature of the claim did not fall within CPR 46.24(1) and was not an Aarhus Convention claim. The court therefore had no power to make a protective costs order. Further, the court declined to make a costs-capping order, given that effective costs management would be a better instrument to prevent disproportionate costs.
